The InsuranceTekServices.com website located at https://insurancetekservices.com/ (the "Site") will enable you to access information about various types of insurance, insurance options and provider information. When you use this Site, you represent and warrant that you understand that the Site is not affiliated with or managed, endorsed or sanctioned by any insurance carrier or any state or federal governmental entity.
THE AGREEMENT CONTAINS DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, RELEASES, A CLASS-ACTION WAIVER AND THE REQUIREMENT TO ARBITRATE ANY AND ALL CLAIMS THAT MAY ARISE HEREUNDER. THIS ARBITRATION AGREEMENT INCLUDES CLAIMS RELATED TO OUR CLIENTS, VENDORS, AND MARKETING PARTNERS, WHICH ARE THIRD PARTY BENEFICIARIES OF THIS ARBITRATION AGREEMENT. THE AFOREMENTIONED PROVISIONS ARE AN ESSENTIAL BASIS OF THE AGREEMENT.
The Site is an Internet property of INSURANCETEK SERVICES, LLC. and its affiliated companies ("InsuranceTekServices.com," "we," "our" or "us"). You are agreeing to comply with and be bound by the following InsuranceTekServices.com Terms and Conditions ("Terms and Conditions") when you: (a) access the Site; (b) apply for, request or obtain information and/or rate quotes regarding third party insurance-related products and/or services ("Rate Quote Services"); and/or (c) view certain content, links, and other material pertaining to Third Party Service Providers or insurance-related information (collectively, "Content," and together with the Site and Rate Quote Services, the "Site Offerings").
The InsuranceTekServices.com Privacy Policy ("Privacy Policy") and all other applicable policies, rules, price schedules and supplemental terms published from time to time are incorporated by reference into this Agreement.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY, YOU ARE NOT AUTHORIZED TO USE THE SITE OFFERINGS.
INSURANCETEKSERVICES.COM IS A PRODUCT AND SERVICE MATCHING SERVICE AND IS NOT A LICENSED INSURANCE BROKER, CARRIER, OR DIRECT PROVIDER OF INSURANCE PRODUCTS. WE MATCH CONSUMERS WITH THIRD PARTY PROVIDERS BASED ON THE INFORMATION SUBMITTED. IN ORDER TO PERFORM MATCHING SERVICES, WE MAY REQUIRE YOU TO SUBMIT HEALTH INFORMATION. THIS INFORMATION WILL ONLY BE USED TO FACILITATE MATCHING WITH THIRD PARTY PROVIDERS WHO CAN PROVIDE QUOTES.
You agree to the terms outlined in the Agreement with respect to your use of the Site Offerings. This Agreement supersedes all prior agreements relating to the Site. We may modify the Agreement at any time without prior notice, except modifications to arbitration provisions will not apply retroactively to disputes arising before such changes. Continued use of the Site constitutes your acceptance of all updated terms.
The Site is available only to individuals who can enter legally binding contracts and are at least 18 years old. We may terminate access at any time for any reason, including breach of this Agreement or improper conduct.
The Site allows users to apply for Third Party Quotes and Products from participating third party insurance providers. We do not offer insurance directly, and all final terms and application approvals are determined by the Third Party Service Providers.
To request quotes, you must complete the Site Application and, if redirected, the TP Application on the Third Party Provider’s website. Any information submitted is governed by our Privacy Policy or the Third Party Provider’s privacy policy, respectively.
We do not endorse any Third Party Provider. Providers pay for access to consumers through our platform. You must use your own judgment when interacting with them.
By using the Site, you release InsuranceTekServices.com from disputes arising between you and any provider.
All content on the Site is for informational purposes only. Reliance on any content is at your own risk. We disclaim liability for any damage arising from use or reliance on such content.
You are granted a limited, revocable, personal, non-commercial license to use the Site Offerings. You may not copy, modify, reverse engineer, scrape, or interfere with the Site or its infrastructure.
All Site content is protected by copyright, trademark, and other proprietary rights. You acquire no ownership of any Site materials.
We may edit or remove any content on the Site at any time in our sole discretion.
You agree to indemnify and hold harmless InsuranceTekServices.com and its affiliates from all claims arising out of your use of the Site, breaches of this Agreement, or disputes with Third Party Providers.
THE SITE AND ALL RELATED SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY. WE DO NOT GUARANTEE THAT YOU WILL QUALIFY FOR ANY THIRD PARTY PRODUCTS, OR THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. IF LIABILITY IS EVER FOUND, IT IS LIMITED TO **$500** MAXIMUM.
We are not responsible for third party websites, content, policies, or practices. Any interaction with a Third Party Provider is solely between you and that provider.
Use of the Site is governed by our Privacy Policy. By using the Site, you consent to all data practices described therein.
Attempts to tamper with or damage the Site may result in civil and criminal penalties.
All disputes shall be governed by the laws of New York. You agree not to participate in any class action lawsuit against InsuranceTekServices.com.
All disputes must be resolved through binding arbitration under the AAA rules, except valid small claims court matters.
You may only bring claims on an individual basis, not as part of a class action or representative proceeding.
Arbitration will be held in your county or another mutually agreed location. The arbitrator shall apply New York law.
If the claim is under $10,000, we will pay required AAA fees upon request. If your claim is deemed frivolous, you agree to reimburse such fees.
Arbitration proceedings and awards are confidential except as required for legal enforcement.
If any arbitration clause is found unenforceable, the remainder of the Agreement remains in effect.
These Terms constitute the entire Agreement. We may assign our rights at any time. You may not assign yours.
